TERMS AND CONDITIONS

The following words have the following meanings: ‘We’, ‘us’, ‘our’, ‘Privilege Card’ ‘KuKu Connect’ are terms used to refer to the Directors of KuKu Connect. We reserve the right to cancel/discontinue/refuse membership at any time.

KuKu Connect Membership is for one year and starts from the day you join. If you have opted to pay for membership on a monthly basis, please note that this is treated as 12 monthly instalments which you are committed to for your full year of membership. Should you cancel your Membership early you will be liable to pay the remaining amount. Should you miss a monthly payment or the payment fail to reach our account your Membership will be paused until this balance is settled.

Membership automatically renews after 12 months, and it is your direct responsibility to give KuKu Connect at least one month’s notice should you wish to cancel your Membership. Failure to do this will result in you entering into a new 12 month agreement.

1 General

1.1 These terms and conditions are the only conditions under which we are willing to provide the service to you as a KuKu Connect member.

1.2 We reserve the right to amend or vary these terms and conditions at any time and without notice.

1.3. Nothing in these terms and conditions shall detract from your rights as a consumer.

1.4. These terms and conditions contain all the terms on which we provide the service to you and supersede any prior implications made.

1.5 These terms and conditions do not create any right enforceable by a person not a party to them.

2 Membership

2.1 Membership is based on a twelve month contract and is renewable automatically. It is your responsibility as a member to ensure you give us 1 month’s notice prior to the end of your annual contract and cancel the Direct Debit should you wish to cancel your membership, otherwise you will automatically enter a new 12 month contract. Should this happen, we are unable to offer a refund.

2.2 We are unable to accept your application without complete and accurate information required by us.

2.3 Membership of the service is only available to persons over the age of eighteen.

2.4 If you have a direct debit set up with us for your membership, you are required to notify us of any changes to your bank and if it is cancelled accidentally, you will be notified by us requesting it be reinstated.

2.5 Should a payment fail for any reason, you will be notified by us and must ensure that the relevant funds reach our bank account within 7 calendar days

2.6 Should membership be cancelled part way through the annual contract, the remaining balance must be paid and will be invoiced to you by us.

2.7 We do not offer refunds on membership whether paid in full or via direct debit.

2.8 If your monthly payment plan is set up on a standing order as opposed to via GoCardless, the above cancellation process still applies.

3 Privilege Card

3.1 The Privilege card remains the property of KuKu Connect at all times.

3.2 The Privilege card must not be lent or given to any other person.

3.3 You will be charged a replacement fee of £10 for a lost, misplaced or stolen Privilege card.

4 Discounts

4.1 As a member you will be notified of all forthcoming Connect Receptions via email or on social media. However, it is your responsibility to access the website for information on forthcoming receptions, events and benefits, review articles and more related features and benefits.

4.2 We have no control over the products or services provided by participating establishments. Should you have any complaints or queries these please contact the relevant establishment directly.

4.3 Discounts, offers and incentives are at the discretion of our participating establishments and are subject to change. Should we be informed of a change, we will do our best to let you know via the KuKu Connect website and/or social media. KuKu Connect is not responsible for any changes that are made by a participating establishment.

4.4 It is the member’s responsibility to check on the KuKu Connect website for the relevant and latest offers.

4.5 Any disputes with a participating establishment should be reported to KuKu Connect by email at [email protected]

4.6 KuKu Connect reserve the right to change any offer and/or affiliated establishments at any time.

4.7 If you become aware of a discontinued offer, please notify KuKu Connect by emailing [email protected]

5 Code of Conduct

5.1 KuKu Connect reserves the right to cancel your membership should you commit any act of unruly behaviour at any KuKu Connect event or within KuKu Connect’s community, this includes any form of communication verbally or in writing including digital formats and anything we reasonably deem as written, verbal and/or physical conflict.

6 Payments & Cancellations

6.1 You acknowledge that all subscriptions are subject to a non-refundable fee.

6.2 You agree to pay an upfront one-off payment for your membership or a monthly direct debit payment plan split over 12 months.

6.3 Should you wish to cancel your membership part way through your membership year then the remaining balance must be settled. This will be made up to the total at the time of cancellation (if a monthly payment plan is set up).

6.4 If your monthly payment plan is set up on a standing order as opposed to via GoCardless, the above cancellation process still applies and no refunds will be given.

6.5 It is your responsibility as a member to ensure you give us 1 month’s notice prior to the end of your annual contract should you wish to cancel your membership otherwise you will automatically enter a new 12 month contract. Should this happen, we are unable to offer a refund.

7 Software

7.1 Any material or data which is downloaded or obtained from KuKu Connect is done so at your own risk. We take no responsibility for damage or loss of data to your computer/device as a result of this.

8 Termination

8.1 KuKu Connect can terminate membership at any time on giving notice to you if you breach the terms and conditions of this agreement. Should this be the case, KuKu Connect will give full and frank reasons for their decision.

8.2 On termination of your agreement for any reason you agree to return your Privilege Card to us.

9 Privacy

9.1 We will request certain information from you in order to issue you with membership. Please only supply information you are happy to send to us and for us to share in order to promote you and your business.

9.2 We will treat your personal details such as your bank account details, home address and date of birth as confidential.

9.3 KuKu Connect reserves the right to inform you of products, services, updates and other related services by email.

10 Copyright

10.1 All material on www.kukuconnect.co.uk is the copyright of KuKu Connect. Should you wish to share imagery, logos or branding of any kind in your own social media and marketing please email [email protected] with details of what you wish to share.

10.2 If necessary, KuKu Connect will enforce its intellectual property rights to the fullest extent of the law which may include seeking legal action.

11 Website

11.1 KuKu Connect do not accept any responsibility for any external links that appear on the website.

11.2 The KuKu Connect website is for the personal use of those who are at the legal age to purchase and consume alcoholic beverages on site within licensed premises.

12 Liability and disclaimer

12.1 We use reasonable care to ensure all information on the website is accurate and up to date. However we shall not be liable for any loss, damage or expense incurred by you as a result of any error or omissions by us or any third party.

12.2 We will not be liable if we are unable to perform our obligations under these terms and conditions due to the failure of any machine equipment, data processing system or transmission link or to any circumstances beyond our control (including but not limited to strike, industrial action, war, acts of terrorism, fire, act of God or accident of any kind).

12.3 Our liability will not exceed the total price paid to us by you for one calendar year of service.

13 Content

13.1 The content of the KuKu Connect website is appropriate only for use within the United Kingdom; however those who choose to access the website from outside the United Kingdom do so at their own discretion and are responsible for compliance with English law.

14 Law

14.1 These terms and conditions are subject to English law and you and we submit to the exclusive jurisdiction of the English courts.
